Overgrown yard, a roof under a tarp, an unpermitted addition, a pool that isn't secured: code violations happen, especially with vacant, inherited or rental properties. In Lake County and its cities, unresolved code violations can lead to fines that keep growing and liens recorded against the property.
How Code Enforcement Generally Works in Florida
Florida cities and counties enforce local codes through code enforcement boards or special magistrates under Chapter 162 of Florida Statutes. In general:
- The owner gets a notice of violation and time to fix it.
- If it isn't fixed, there is a hearing, and the board or magistrate can order compliance and set a daily fine until the violation is corrected.
- The order imposing the fine can be recorded as a lien against the property, and other property you own in the county.
Each city (Eustis, Tavares, Leesburg, Mount Dora, Clermont and others) and unincorporated Lake County has its own code enforcement office and procedures.
Can You Sell a House With Code Liens?
Usually, yes. Liens generally have to be paid, reduced or released for the buyer to get clear title, and that is typically handled at closing. Some options:
- Fix the violation and request a lien reduction or mitigation. Many local governments have a process to ask for a reduction once the property is in compliance.
- Sell to a buyer who will fix it, with the lien payoff handled by the title company from the sale proceeds.
- Negotiate the amount with the city or county before closing.
Why Many Owners Sell As-Is
Fixing code issues can mean contractors, permits, inspections and money you may not have, while fines keep adding up. We buy houses with open code cases and recorded liens. We'll look at what is owed, work with the title company, and give you a clear offer showing what you walk away with.
Call (352) 508-7373 or tell us about the property. We'll get you a no-obligation offer, usually within 72 hours.
General information only. Lien procedures vary by city and county; verify amounts with the code enforcement office and a title company.
