Losing a parent or loved one is hard enough. Then comes the house: the bills, the lawn, the insurance, the belongings and the questions from siblings. Here is a plain-English overview of how selling an inherited home in Lake County usually works.
Does the House Have to Go Through Probate?
It depends on how the home was titled. Some homes pass outside of probate, for example:
- Property held in a living trust.
- Property owned as joint tenants with right of survivorship or as tenants by the entirety (married couples).
- Property with a valid enhanced life estate ("Lady Bird") deed.
If the house was in the deceased person's name alone, it will usually need to go through probate in the county where they lived.
Formal vs. Summary Administration
Florida has two main types of probate:
- Formal administration, where the court appoints a personal representative who manages the estate and can be authorized to sell real estate.
- Summary administration, a shorter process generally available for smaller estates or when the person has been deceased for more than two years.
Florida also has special rules for homestead property, which can affect who inherits the home and whether creditors can reach it. A Florida probate attorney can tell you which path applies.
Who Can Sign to Sell?
Usually the personal representative, with court authority or the power granted in the will, or all of the heirs together, depending on the situation. A title company will confirm who must sign before closing.
Common Problems We See With Inherited Houses
- The house is full of furniture and belongings.
- Deferred maintenance: old roof, plumbing, A/C or termite damage.
- Heirs live out of state.
- Siblings disagree about selling.
- Back property taxes, liens or a reverse mortgage.
- Utilities and insurance are costing money every month.
Selling As-Is Can Save Heirs Time and Money
When we buy an inherited house, you don't have to clean it out, fix it or stage it. Take what you want and leave the rest. We can coordinate with your probate attorney and title company, and closing can often be handled remotely for out-of-state heirs. Liens and taxes are typically paid from the proceeds at closing.
